The Online Platform "www.stock-meat.com", hereafter referred to as "STOCK-MEAT", is owned and operated by STOCK-MEAT SRL, having the following identification data: Single Registration Code 35352700, registered with the Trade Registry under no. J40/15591/2014, with headquarters in Bucharest, Romania, 96 Berceni Road, District 4, telephone +4021 4505064, fax +4021 4505063, e-mail email@example.com . Any reference to STOCK-MEAT will include implicitly the holding company.
STOCK-MEAT is an online platform that provides global brokerage and promotion services for merchandise selling products from the meat industry to legal entities operating in this field.
By browsing the Online Platform and creating a user account, the person in question declares that they have read, understood and accepted the Terms and Conditions of Use of the Online Platform in their entirety. Please read them carefully.
STOCK-MEAT reserves the right to change and update at any time the content of the Online Platform and the Terms and Conditions of Use without any prior notice. In the event of divergences or misunderstanding between STOCK-MEAT and the User, the version of the Terms and Conditions valid at the time of the conclusion of the Contract and/or the Transaction shall apply.
1.1. Online Platform - represents the website "www.stock-meat.com", through which the Intermediary offers Global Promotion and Mediation Services for Selling and Purchasing Products in the Meat Industry, interfering and facilitating the conclusion of the Transaction;
1.2. Services - are the promotion and brokerage intermediary services offered on the Online Platform, through which the Intermediary connects Sellers and Buyers with the purpose of concluding sales contracts for the Products. Some Services may be provided by STOCK-MEATâ€™s affiliates on behalf of STOCK-MEAT;
1.3. Contract - is the contract concluded by STOCK-MEAT with the User at the time of registration on the Online Platform, together with any Annexes and/or Additional Documents, integral parts of the contract;
1.4. User Account - is the section of the Online Platform allocated to each User, consisting of the user name, the e-mail address and the password that allows the User to submit the Offer and/or place the Order and that contains information about the identification data and the history of the User while using the Online Platform, such as placements, orders placed, transactions completed, invoices, payments made, etc.
1.5. User - represents any person registered on the Online Platform who, by creating the Account, has expressly accepted the applicable Terms and Conditions of Use. The User is a professional natural or legal person governed by public or private law who, in a civil law relationship, acts for purposes relating to the business or professional activity even if the person does not have the purpose of earning a profit from that activity;
1.6. Intermediary - represents the company STOCK-MEAT SRL, which offers the services through the Online Platform;
1.7. Seller - represents the User who places the Online Sales Offer for Products;
1.8. Buyer - means the User who performs an Order for Products Offered on the Online Platform;
1.9. Offer - is the Offer submitted by the Seller by posting on the Online Platform, containing the Product Range and the Displayed Price;
1.10. Products â€“ livestock, meat, meat products, sausages, by products, spices and ingredients, fish and seafood products, derived products, equipment and machinery etc., as determined in the Offer;
1.11. Negotiation - represents the stage in which the Seller and the Buyer submit their request and offer, determine the quantity of Products, the Transaction Price, the Payment Method, the terms and conditions of delivery, etc., performed via the Online Platform;
1.12. Firm Order - represents the electronic document that acts as a form of communication between the Seller and the Purchaser through which the latter communicates to the Seller through the Online Platform the intention to purchase certain Products and to make their payment under negotiated terms;
1.13. Order Confirmation - represents the electronic document transmitted by Intermediary to the Buyer, after the Seller confirms that he agrees to sell and deliver the Products and will honor the order within the specified terms. By confirming the order, the transaction is considered terminated between the Seller and the Purchaser;
1.14. Transaction - the agreement concluded between the Seller and the Buyer, by meeting the Seller's offer with its acceptance by the Purchaser, being terminated at a distance without simultaneous physical presence of the Seller and the Buyer;
1.15. Comission - represents the commission payable to the Intermediary by the User, based upon the Contract, for the provision of Intermediation Services and is calculated by reference to the Transaction Price;
1.16. Displayed Price - represents the price sent by the Seller through the Offering;
1.17. Transaction Price - is the price (without VAT) payable by the Buyer for the Products purchased through the Transaction;
1.18. Payment Method - represents the option of the payment method of the Transaction Price agreed by the Seller and the Purchaser within the Negotiation;
1.19. Rating - a way of expressing the satisfaction of a User/Buyer over a product. The rating is expressed in the form of stars, each good being able to receive a score from a star at five stars. This degree of satisfaction will always be associated with the User/Buyer's written review of a Good or Service;
1.20. Question - addressing formula to other Users in order to obtain information about the Goods or Services on that page;
1.21. Answer - written information that is sent to the User who has addressed a Question on the Online Platform expressed in a discussion;
1.22. Commercial Communications - any type of message sent (such as: e-mail/SMS/phone/mobile push/ webpush, etc.) containing general and thematic information, information about similar or complementary products to those you have information on offers or promotions, information on Goods and Services added in the User Account/Shopping Cart section or the User Account/Favorites section as well as other commercial communications such as market research and opinion polls;
1.23. Specifications - all specifications and/or descriptions of Goods and Services as specified in their description;
1.24. Agent - means the intermediary`s affiliate who act as his agent and provides brokerage services.
2.CONTROL ON THE ONLINE PLATFORM. CREATING THE USER ACCOUNT
2.1. To create an account on STOCK-MEAT, the User is required to use a valid e-mail address.
2.2. Visiting the Online Platform does not require your previous subscription or registration as a user. However, if you choose to use certain services or contents of the website, we may request that you register in our system. The Use of the Online Platform implies full acceptance of the Terms and Conditions under which the Services are provided, account creation and operations on the Online Platform equivalent to accepting the Terms and Conditions.
2.3. The User is responsible for maintaining the confidentiality of the User Account and password data and for restricting access to the User Account, which is used only by the responsible persons and the legal capacity to represent the User in the activities performed on the Online Platform. The User assumes responsibility for all activities performed through the User Account and the associated password. In order for us to keep your personal data updated, it is important that you keep us informed about any modification. Any unauthorized use or security infringement related to the website operation should be reported at firstname.lastname@example.org.
2.4. STOCK-MEAT assumes no responsibility or liability with regard to data and information published on the Online Platform. Users who place Offers, list business proposals, pictures or other information on the Online Platform assume that they have this legal right from the entity on whose behalf they are doing so. STOCK-MEAT may require Users to prove this right.
2.5. Without prior notice and at any moment, STOCK-MEAT may refuse the application for registration or may unilaterally suspend the access to the Online Platform or may close the account in cases where it finds that the applicant has used information that is not in conformity with the facts or uses the Services in violation of the Terms and Conditions. STOCK-MEAT may also close an User Account for posting promotional materials without its express consent.
STOCK-MEAT will display the Offer within the Online Platform without providing Seller details. Information on data identification of the Users will be anonymized and subsequently transmitted in accordance with the Settlement Policy set out below.
4.1. The information provided on the STOCK-MEAT Online Platform is provided/listed by Users in order to provide interested parties with data and information of general interest as well as proposals for the sale and/or purchase of Products and the identification of business partners from all over the world.
4.2. The information provided on the Online Platform does not have firm demand or offer value. Online Trading will take place under the Trading Policy, detailed below, within the Terms and Conditions.
4.3. In the relationship between the Intermediary and the related parties (the Seller and the Buyer), the Intermediary acts as an independent, there being no relationship of subordination or redundancy between the intermediary and the intermediate parties.
4.4. Users recognize the importance of the Services provided through the Online Platform, which involves the protection of the rights, interests and benefits of the Intermediary, this being achieved only by acting in good faith in the fulfillment of the undertaken obligations. In this respect, STOCK-MEAT assumes no responsibility for the fulfillment of the obligations of the Transaction by the Contracting Parties.
4.5. STOCK-MEAT does not undertake to guarantee the solvency of Users.
4.6. STOCK-MEAT does not assume responsibility for the descriptions of products presented on the Online Platform, which are made available to STOCK-MEAT by Users.
4.7. STOCK-MEAT does not accept the responsibility to guarantee the availability of the Products, the quality conditions, compliance and provenance of Products in the Offer posted on the Online Platform.
4.8. STOCK-MEAT does not assume the fulfillment of the legal requirements in the State of origin and destination of the Products, but not limited to, production, storage, processing, packaging, transport, etc.
4.9. Information posted on the Online Platform is informative and must be made available by Users in good faith.
4.10. STOCK-MEAT reserves the right to cancel Product Orders that are displayed on the Site as a result of technical errors, or which, due to technical errors, display erroneous or derisory pricing.
4.11. Due to the nature of the electronic communication processes, STOCK-MEAT does not guarantee or assure that the Online Platform, the servers it hosts or the emails sent are free of viruses or other potentially damaging computer components, that it contains no errors, omissions, malfunctions, delays or interruptions in operation or transmission. Accordingly, the data and information are provided without warranties, express or implied, including but not limited to the accuracy, timeliness and/or completeness of the information provided.
4.12. Some information published on the Online Platform may redirect the User to internal and/or external websites, these links being offered by STOCK-MEAT as a user-friendly facility and for strictly informative or marketing purposes. STOCK-MEAT does not control and is not responsible for any of these sites or their content nor can it guarantee in any way that these links will not change over time. In order to protect reputation and trademarks, STOCK-MEAT reserves the right to request at any time the removal of any link to or from that web site.
4.13. STOCK-MEAT assumes no liability if certain information is provided late, is lost, deleted, or cannot be stored on its servers for reasons that cannot be attributed to it. STOCK-MEAT is in no way responsible for the way in which information provided through the electronic trading system on the market administered by STOCK-MEAT is taken over or stored by Users.
4.14. The User expressly accepts that registration, account creation and the use of the Online Platform are at his own risk.
5.STOCK-MEAT TRADING POLICY
5.1. The Seller places the Product Offer on the Online Platform, providing the features, data and information of general interest, the Displayed Price of the Products, etc. Sellerâ€™s ID details will not be available at this stage.
5.2. The Displayed Price is exwork, does not include VAT, commission or other export-import taxes.
5.3. The Buyer can place orders on the Online Platform by adding the desired Products to the shopping cart. Once added to the shopping cart, the Product is available for purchase to the extent that there is a stock available for that. Adding a Product to the shopping cart, in the absence of completion of the Order, by confirming it by the Seller through STOCK-MEAT, does not imply the conclusion of the Seller's and Buyer's Transaction implicitly.
5.4. The User interested in the Posted Offer will transmit to STOCK-MEAT, by adding the Products to the shopping cart or by direct request on the Platform, a Negotiation (Purchase) request for the Products concerned. The entire Negotiation between the Seller and the Purchaser will be mediated online through the STOCK-MEAT Platform.
5.5. The Negotiation will determine the quantity of Products ordered, the Transaction Price, the delivery terms, the way of payment of the Transaction Price and the Commission.
5.6. After the parties reach an agreement on all aspects of the Transaction, the Buyer submits the Order to the Seller, via STOCK-MEAT.
5.7. With the delivery of the Order, the Purchaser agrees that all data provided by him to STOCK-MEAT, mandatory for the purchase process, are correct, complete and true at the time of placing the Order, otherwise being liable for any consequence or prejudice created by these errors.
5.8. After confirmation of the order by the Seller, STOCK-MEAT will send the Purchaser Order Confirmation, moment from which Transaction is deemed to be concluded, subject to the parties' obligation to execute the Transaction under negotiated terms.
5.9. With confirmation of the order, the Seller agrees that all data provided by him to STOCK-MEAT, mandatory for the sale process, are correct, complete and true at the Confirmation of the Order, otherwise he will be liable for any consequence or damage caused by these errors.
5.10. After paying the Commission to STOCK-MEAT under the conditions set forth, the Intermediary shall provide the Seller with Buyer identification data and Buyer with the Seller's identification data for the execution of the Transaction.
5.11. Upon the conclusion of the Transaction, the User agrees that STOCK-MEAT or the co-contracting part of the Transaction may contact him/her via e-mail, telephone or notification within the Platform, whenever contact is required, in connection with the execution of the Transaction and contract.
5.12. In maximum 5 days after the execution of the Transaction, the Users will transmit the proof of delivery, compliance, payment etc. If one of the Contracting Parties to the Transaction invokes the non-execution, the evidence will have to be transmitted to STOCK-MEAT within the same 5-day period from the date on which the obligation should have been executed. In this case, in 30 days STOCK-MEAT will reimburse the fee paid by the party whose fault cannot be withheld in the failure to execute the contract if the documents submitted will unequivocally result in it. If the documents referred to in this article are not submitted within the said deadline, the User will no longer be able to claim the refund of the commission.
5.13. Using any STOCK-MEAT service, sending emails, telephone messages, text messages and other communications via the Online Platform, is carried out remotely, electronically. For contractual purposes, the User declares that he agrees to receive electronic communications from STOCK-MEAT and that all understandings, notices, disclosures and other communications provided in electronic form meet any legal requirement of liability. This form of communication covers both the contractual relationship between STOCK-MEAT and the User, as well as those born through the Online Platform between Users.
6.BILLING. PAYMENT OF INTERMEDIATE SERVICES
6.1. Prior to the Confirmation of the Order, the Intermediary will issue the Proforma invoices related to the Commission and will transmit them to the Users under the terms of the Contracts concluded with them, the Commission being determined by reference to the Transaction Price concluded between the Seller and the Buyer.
6.2. The payment method and deadline will be specified in the Contract concluded between STOCK-MEAT and the User.
6.3. After paying the Proforma invoice for the Commission, the Intermediary will issue and send to the User the tax invoice.
7.1. By transmitting information or materials through the Online Platform, the User grants STOCK-MEAT unrestricted and irrevocable access to the right to use, reproduce, display, modify, transmit and distribute such materials or information.
7.2. By entering the STOCK-MEAT database, the User expressly agrees, within the limits of the applicable law, to be contacted by third parties, STOCK-MEAT partners, marketing service providers, other service providers in order to fulfill the object of the Agreement concluded between the Intermediary and the User, as well as by other companies with which STOCK-MEAT can develop joint programs for the market offer of the Products.
7.3. STOCK-MEAT reserves the right to use the data collected from Users for the improvement of its own services. STOCK-MEAT assures Users that they will not make the e-mail addresses or personal data available to third parties, except for the above mentioned partners. STOCK-MEAT also reserves the right to make this data public in a statistical form to indicate the Online Platform Users profile.
7.4. On the other hand, the User undertakes to keep confidential the information he/she acquires through the Online Platform. Confidential information means any information that is not public and which relates to STOCK-MEAT's operations or activities if communicated to the user by STOCK-MEAT or by third parties and which are designated as confidential or which, in the view of the nature of the information or the circumstances in which the disclosure was made should be considered as confidential.
7.5. The confidentiality obligation of the information received by the User includes both the information transmitted before and after the commencement of contractual relations. The User's obligations with respect to confidential information remain for five (5) years after termination of the STOCK-MEAT reports.
7.6.Confidential information includes, without limitation, information on STOCK-MEAT's technology, customers, business, marketing, finance and other business, nature, content and existence of any agreement, discussion or negotiation between STOCK-MEAT and User, etc.
7.7. The User may use confidential information only for the purpose of the relationship between him and STOCK-MEAT. Except as expressly provided in the Terms and Conditions, the User will not disclose confidential information to any third party without the prior written consent of STOCK-MEAT. The User will take all reasonable steps to avoid the disclosure, dissemination or unauthorized use of confidential information. The user assumes responsibility for the confidentiality of the information by the hired personnel.
8.1. On the Online Platform, STOCK-MEAT displays advertising based upon the interest of the User, using the information that he provides when interacting with our site, content or services, such as purchasing through the Online Platform, using devices, applications or software, visiting sites that contain links or STOCK-MEAT ads.
8.2. STOCK-MEAT offers the User options for receiving interest-based ads. The user may choose not to receive such ads from STOCK-MEAT. By selecting this option, the user can still view ads, but they will not be personalized.
8.3. STOCK-MEAT Newsletters are transmitted directly or through the specialized and approved partners of STOCK-MEAT. This ensures confidentiality and security of information.
8.4. When the User creates an account, he/she has the opportunity to agree to receive Newsletters.
8.5. User can modify his/her option regarding the agreement issued to STOCK-MEAT at any time. Discontinuing receipt of the Newsletters does not imply giving up the agreed Terms of Service.
9.PERSONAL DATA PROTECTION
9.1. In accordance with the requirements of Law no. 677/2001, on the protection of individuals with regard to the processing of personal data and the free movement of such data, as amended and supplemented, STOCK-MEAT has the obligation to administer safely and only for the specified purposes, the personal data that the Users provide to us.
9.2. We receive and store information that the User introduces to the Online Platform or otherwise provided to us. For example, you provide information when you:
use our services;
provide information to the user account;
look for a product;
select certain Products and go through the Negotiation phase;
place an order through STOCK-MEAT to Sellers;
complete Transactions via the Online Platform;
communicate with us by phone, email or otherwise;
participate in discussion forums within the Online Platform;
provide and evaluate reviews.
9.3. After these actions, you may provide us with information such as your name, address, e-mail addresses and telephone numbers; bank account information; people to whom the Products are shipped, including addresses and phone number; e-mail addresses of employees and/or other people; content reviews and e-mails to us.
9.4. You may choose not to provide certain information, but you may not be able to take advantage of many of our functions and services in this case. We use the information you provide for the purpose of providing Services, such as promoting and mediating Transactions between Users in response to your requests, personalizing future sales/purchases, improving our Services and communicating with Users.
9.5. The use of the Online Platform is primarily intended for legal entities, with the goal of linking business partners globally. Thus, STOCK-MEAT cannot be used by minors.
9.6. The purpose of data collection is:
informing the User of the account status, including account validation, transactions made, negotiations through the Online Platform, order confirmation, commissioning of the Commission, procedures or problems of any kind related to the trading activity, purchased products, etc .;
promotion and intermediation of Transactions concluded between Users;
in a statistical form, in order to indicate the Profile of Online Platform Users, Market Research, Tracking and Monitoring of Transactions and User's Behavior;
sending periodic newsletters and/or alerts, using remote means of communication (e-mail, SMS, notification).
9.7. We receive and store certain types of information each time you interact with us. As we have stated, we use "cookies" and we obtain certain types of information when the web browser accesses "www.stock-meat.com"or advertisements and other content served by or on behalf of STOCK-MEAT on other Web sites. 9.8. We work closely with other partners. In some cases, such as Market Sellers, these companies operate through the Online Platform by providing Offers to Buyers. The transaction ends via STOCK-MEAT, but directly between the Seller and the Purchaser. Therefore, a third party is involved in the Online Platform operations and we share information about Users related to these transactions with that third party.
9.9. STOCK-MEAT hires other companies and individuals to perform functions on our behalf. Examples include transmission and Order Confirmation, electronic mail, data analysis, marketing support, providing search results and links (including records and paid links), customer service. They have access to the personal information needed to perform their functions, but they cannot use them for other purposes.
9.10. STOCK-MEAT may also provide the personal data of the Users of other companies with which it is in partnership, but only under a confidentiality commitment on its part and only for the purposes specified in this Terms and Conditions of Use, whereby the third party guarantees that these data are kept secure and that the provision of such personal information is made in accordance with the applicable law as follows: to marketing service providers, payment/banking services providers or other services provided by companies with whom we can develop joint marketing programs for our Services.
9.11. STOCK-MEAT will release personal information when required to comply with the law and/or at the request of the competent authorities; for the purpose of implementing the Terms and Conditions of Use; to protect the property rights or the safety of STOCK-MEAT, our Users or other persons. This includes sharing information with other companies and organizations to protect and reduce the risk of fraud. These cases do not include the sale, hiring, sharing or otherwise disclosing personally identifiable information from customers for commercial purposes in violation of the commitments set forth in the Terms and Conditions.
9.12. In addition to the above, you will receive a notice when your information may be passed on to third parties and you will be able to choose not to distribute the information.
9.13. STOCK-MEAT offers the User access to a wide range of Account Information and Interactions with the Online Platform for the limited viewing and, in some cases, updating of that information. When you update the information, STOCK-MEAT will retain a copy of the previous version for Securing Transactions and Contracts concluded with Users.
Examples of information that you can easily access on STOCK-MEAT include up-to-date information on recent orders; personal identification information (including name, e-mail, password, communications and personalized advertising preferences); payment settings shopping lists; transactions; contractual partners; your profile (including ordered products, reviews, recommendations, etc.).
9.14. If you do not want to use the personal information we collect in order to allow you to optimize the Services or to allow third parties to customize the ads we display to you, please adjust your advertising preferences.
9.16. By using the Online Platform and accepting the Terms and Conditions you have acknowledged that you are guaranteed the rights provided by the law, namely the right to information, the right of access to data, the right to intervene, the right to object, the right not to be subject to an individual decision, the right to address to justice in case of violation of the rights guaranteed by Law no. 677/2001 on the protection of individuals with regard to the processing of personal data and the free movement of such data.
9.17. On the basis of a written, dated, signed and dispatched request to the contact address of STOCK-MEAT, you may request that you confirm that personal data is processed or not.
9.18. On the basis of a written, dated, signed and dispatched request to STOCK-MEAT contact address, you may exercise the right to interfere with the data as appropriate:
rectification, updating, blocking, anonymisation or deletion of the processed data of which is not in accordance with the applicable law on the processing of personal data and the free movement of such data, in particular incomplete or inaccurate data;
notification to third parties to whom data has been disclosed.
10. FORCE MAJEURE
10.1. None of the parties shall not be liable for the non-performance of its contractual obligations if such non-performance in time and/or duly, wholly or in part, is due to a force majeure event. Force majeure is an event beyond the control of the parties, unpredictable and insurmountable, which is not due to their intentions or culpability, which occurred after the entry into force of the contract and which prevented the contracting parties from fulfilling all or part of their obligations.
10.2. If, within 15 (fifteen) days of its occurrence, that event does not cease, each party shall have the right to notify the other party of the termination of the contract without one of them being able to claim the other damages.
11. INTELLECTUAL PROPERTY
11.1. STOCK-MEAT is a registered trademark. The content of the STOCK-MEAT Online Platform, including, but not limited to, name, logo, trademark, stylized representations, web graphics elements, software, images, texts, etc., is the exclusive property of STOCK-MEAT and its suppliers and is protected by Law no. 8/1996 on copyright and related rights, the legislation on intellectual and industrial property, being reserved all rights directly or indirectly obtained in this respect.
11.2. The User is prohibited from copying, distributing, publishing, transferring to third parties, modifying, altering, using, removing the sign that signifies the copyright of STOCK-MEAT on the content. These operations may only be permitted with the express written consent of STOCK-MEAT.
11.3. Any use of the content of the STOCK-MEAT Online Platform is forbidden for purposes other than those expressly permitted by the Terms and Conditions of Use or by the Agreement concluded with the User.
12. LIMITATION OF ACCESS TO THE ONLINE PLATFORM
12.1. The Online Platform Users may comment by any other means, submit suggestions, questions or information if their language is civilized and the content of the communications is not illegal, obscene, threatening, defamatory and in no way disturbs the privacy of others, do not violate intellectual property rights, contain no viruses, do not serve promotional campaigns, there are no mass emails or any other form of spam.
12.2. Subscriptions may be made by Users via their own account. Within this section, each User must comply with the following rules:
The User will use an appropriate, non-defensible language without terms that may harm or affect any other User;
The User will not attempt to defraud the services provided by STOCK-MEAT and will not record any communications containing advertising material;
The communications may only refer to the general characteristics of a particular Product, this feature being used only to communicate or obtain additional details of certain products, without reference to other companies promoting the sale and purchase of such products, avoiding information on promotional or bidding issues;
The User will not provide and/or request by any means identification data (contact details, delivery or home address information, telephone numbers, e-mail addresses, name, etc.) or any other information that may cause disclosure of such data;
The user will not enter information and/or links from other commercial sites that carry the same commercial activity as STOCK-MEAT or directly to Sellers;
Communications submitted by Users must be realistic, fair, verifiable and in accordance with the applicable laws, including the rights of other parties such as, but not limited to, copyright, trademark, license or other property rights, advertising or privacy;
Users who attach photo or video files will also follow subsequent rules such as: uploaded files respect copyright; uploaded files will not contain violence, adult content, license language or other content that offends a person or a group based on race or ethnicity, religion, disability, gender, age, sexual or political orientation; uploaded files will not contain information about others;
12.3. The User will also be able to add a relevant review for the Products.
12.4. If STOCK-MEAT repeatedly finds violation of the Terms and Conditions of Use, it reserves the right to suspend the User's ability to write communications on the Online Platform.
12.5. Persons who will use a false e-mail address or will transmit electronic messages or any other communications on behalf of another natural or legal person or on behalf of any other entity will be reported to the competent authorities. STOCK-MEAT assumes no liability and will not be held liable for any damages whatsoever for any damages caused by such communications.
12.6. Any attempt of fraud or any fraud (such as but not limited to: accessing STOCK-MEAT Users' data, alteration of Online Platform content, attempting to affect the performance of STOCK-MEAT servers, etc.) will be punished according to the legal provisions in force.
12.7. For complaints or complaints related to communications, Purchased Products or Transactions concluded, Users have at their disposal the STOCK-MEAT Online Platform notification form.
13. APPLICABLE LAW. JURISDICTION
13.1. The Terms and Conditions of Use are governed by the provisions of the Romanian legislation.
13.2. Any possible disputes that may arise in connection with the Terms and Conditions of Use will be settled amicably. If this is not possible, they will be settled by the competent courts in Bucharest, Romania.
14.1. The partial or total nullity of any clause in the Terms and Conditions of Use will not affect the validity of the other clauses. The Inoperative Clause will be replaced by an appropriate clause which, in accordance with the legal provisions, is the closest to what the Parties have intended.
14.2. The provisions of the Terms and Conditions of Use shall be supplemented by the provisions of the Romanian Civil Code as well as the provisions of the Romanian legislation in force, applicable to legal relations between STOCK-MEAT and the User.
14.3. The English language version of STOCK-MEAT Terms and Conditions of Use governs the uses of the Services or the Online Platform.
